Egads! Construction Move!

It's happened again -- the dreaded move. Though we had a long-term lease at our otherwise wonderful Music Row office, those of you who have visited with us for very long are aware that we had some incompatible serious rockin' noise from our upstairs musical neighbors. Despite months of less major attempts by the landlord to resolve the problem, we were finally notified in early July that he saw no way to help us other than a major reconfiguration of the office space. Sadly, we were forced to make a quick exit to allow construction to begin in earnest. For my many long-term clients who recall my many involuntary moves since the fire 3 years ago, you know how much I hated this news -- which is why I had a lease with options for up to 8 years at that space.

Alas, I finally decided this time not to take the only thing available on the Row. I have moved for the time being into offices just down the street at 2400 Crestmoor Road, Nashville, TN 37215 and will be using their administrative staff while I give myself a chance to determine the best situation while still serving my clients' needs. The phone and FAX numbers are the same. Please use the new address, as we are experiencing some problems with mail getting forwarded!

Taxes and Divorces

What a busy time! I have been going at quite a pace. Lots of filing cases, settling cases, and trying cases in court. With the time for filing tax returns also comes the statute of limitations for past years' tax returns. That means we have had lots of calls from clients with tax problems, and one emergency that required a suit to be filed with the U. S. Tax Court. In the meantime, some of my particularly complicated family law cases have been finalized recently with trials and mediated settlements. I am always amazed how much my financial experience from tax cases comes into play when we are trying to work out those last details that are holding up the deal at the last minute!

Child Relocation/Move Cases - T.C.A. 36-6-108

We are dealing with several cases involving the Tennessee relocation statute for divorced parents or parents with children who never married but have custody orders. I am always surprised how many parents are not aware of the legal requirements that attach to moving if you have a custody order. The law does not make it impossible to move, but if a parent fails to follow the law and go back to court in advance, it is much more difficult to resolve the problems created and can result in the loss of custody. Further, if you are the parent who wants to stop the move, you have rights, too, and may well have a case to do so. The Tennessee statute has very specific requirements that must be followed long before a move begins. If you or the other parent of your child is contemplating a move, you should consult with a very knowledgeable attorney months before the contemplated move, if at all possible. The sooner the better! Do not let this become a horror for everyone involved, particularly the child caught among both parents, all the grandparents and extended family, the courts and attorneys who will only be left to do the best they can under the law and facts that you have given them by that time. Regardless of the point at which you realize a move out of state is going to affect your child and you, remember that a Modified Custody Order will be required, and contact a knowledgeable attorney, whether it is our office or someone else of your choosing.

Paula has many years legal experience, having worked for Judge Randy Kennedy before he was elected to the bench, coming to us at his high recommendation. New Year, New Attorney, New Cases

We are loving our new offices at 1105 16th Ave. South, Suite C, Nashville, TN 37212. We have started off the New Year with another attorney moving into the Suite sharing office space, Jean Harrison. Jean has ten years experience in construction law and is a very fun addition to the office, also.

We have several exciting cases underway in the office at present, both in the areas of divorce and entertainment. We hope all our clients had good holidays, and we look forward to serving you in 2008. Remember that all our contact information remains the same except our address.

Busy Week - July 30th Through August 3rd, 2007

This has been a busy week in our office. We are in the process of moving to our new office suite a couple of blocks down on Music Row at 1105 16th Ave. South, Suite C, Nashville, TN 37212. Our telephone will remain (615) 320-6566, and our facsimile will likewise stay (615) 320-1957. There may be temporary disruptions of telephone, facsimile, or e-mail/computer capabilities on either or both this Friday or Monday, August 3rd and 6th. Hopefully we will be back up and running full steam by the end of Monday in a wonderful new office that our clients will find comfortable and convenient. Attorney Ashlie Weeks of Franklin will also become "Of Counsel" to our office and be located there as well.

This has also been an extraordinarily busy week in court for me. In addition to several other cases with immediate demands, I was in Williamson County Chancery Court most of Tuesday with several motions involving significant assets and debts that were set for hearing in one divorce case. After hours of negotiations, we eventually settled all and were able to announce the settlement to the court. Today I was in Fourth Circuit Court before Judge Muriel Robinson on a Contempt Petition I had filed on behalf of my client after having won a petition earlier this year that allowed my client to relocate to another state. After having prepared for the case until almost 11:00 p.m. last night, we finally reached a form of agreement that my client and I believe is in the best interest of the child at this time, and it likewise was announced in court this morning, but not without some appropriate input from Judge Robinson.
